Please read these terms & conditions carefully before using WNDY.APP website or mobile applications which are operated and managed by ZAG TECH SOLUTIONS PRIVATE LIMITED

Your access to and use of the service is condition to your acceptance of and compliance with these terms and conditions. These terms and conditions apply to all visitors, users, and others who access, download, register, and use the WNDY website/application. By accessing, downloading, or using the WNDY website/application you agree to be bound by these terms. If you disagree with any part of the terms then you may not access the website/application.

Intellectual Property Rights

WNDY is owned and managed under the copyright act by ZAG TECH SOLUTIONS PRIVATE LIMITED. All aspects of the WNDY website and application, such as the designs, transactional flow, look and feel, contents, graphics, and images including the logo are protected under the copyright act. As the law enforces, users are restricted from copying, downloading, reusing, reconfiguring, or imitating any of the proprietary material. Any such activity is expressly prohibited without prior written permission of ZAG TECH SOLUTIONS PRIVATE LIMITED or the written consent of the owner. ZAG TECH SOLUTIONS PRIVATE LIMITED can identify engagement by any user in such prohibited act(s) and if ZAG TECH SOLUTIONS PRIVATE LIMITED identifies that any user has engaged in such activities; appropriate legal action may be taken, including without limitation civil, criminal, and injunctive redress.

Use of WNDY (Web/App)

WNDY is a common platform for sellers (the term SELLER means the person who owns the material and schedules the pickup) and buyers (the term BUYERS means the people who are interested in buying the materials) that may contain profiles, email facilities, chat facilities, blogs, and other communication channels to communicate with each other or to avail the services. Hence, users may use these facilities only to send and receive messages that are relevant and appropriate for the intended use. Violation of this term may force ZAG TECH SOLUTIONS PRIVATE LIMITED to take appropriate legal action against the user, including without limitation civil, criminal, and injunctive redress.

Terms for Sellers & Buyers

  1. Our service is available through helpline numbers on call. Due to certain limitations, we appeal to our prevailing and future customers to utilize our service through the website and mobile application. Our online service has been dedicated to better user interaction with 100% outcomes of success.
  2. Provide an accurate address for the pick-up service.
  3. Rates may vary depending on the location and may be directly negotiated between the Seller and Buyer of the materials. There will be no return of Scrap/Trash which is sold using the Application as it will be recycled.
  4. Rates of scarp not listed in the Web/App can be fixed at the time of collection.
  5. Pickup can be cancelled / rescheduled by direct interaction between the buyer and seller.
  6. Evaluation of Scrap will be done on spot by the Pickup Team as per the value of the Scrap/Trash.
  7. We will always abide by the rules and regulations of Govt of India.
  8. We shall take our customer's feedback and concerns seriously on any matter which pertains to our services. Be free to contact us and share your experience of our service and refer to all your dear and near ones.

Changes to the ‘Terms & Conditions' and Other Policies

ZAG TECH SOLUTIONS PRIVATE LIMITED reserves the right, at our sole discretion, to modify, delete, or replace the terms and conditions or any other policies at any time, with or without prior notice to the user. What constitutes a material change will be determined at our sole discretion. We ensure our sincere effort to bring the changes via mail and application to accept the changes. We request the users and service partners visit the policies and terms & conditions at a certain frequency to update the same. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

INFORMATION

WNDY is a platform that facilitates the supply chain waste of electronic, Plastic bottles, Glass bottles, Newspapers, Cardboard, Books, Metals, Furniture, Batteries, Utensils. WNDY understands the importance of privacy and of maintaining the confidentiality of personal information. Our Privacy Policy is applied to all the products and services which are being provided by us, and sets out how we may collect, disclose and use the personal information (name, address, localization, etc.) of users. Users may use our services and products via Mobile, Desktop, or by calling the Customer Support Team. By using our website, you hereby consent to our Privacy policy and agree to its Terms and conditions.

COLLECTION OF INFORMATION

  1. Your privacy is important to us, and we have taken steps to ensure that we don’t collect more information from you than is necessary for you to utilize our services and to protect your account.
  2. We may collect your personal information at the time of registration and usage like name, address, mobile number, phone number, and the user's location on the Desktop or Mobile Application.
  3. We record & maintain the activities which are being performed by the users on the site.
  4. During the registration, users need to provide the mandatory information in certain categories like - business data (registration information, tax details, etc.) or personal data (name, contact number, address, etc.). If the user does not provide the mandatory information, then we may not be able to complete the process of registration and then we will also not be able to deliver our services to the users.

USE OF PERSONAL DATA

If the user is providing us any Personal Data, then that means the user is giving us rights to use their information for the following purposes:

  1. Verifying the identity of users;
  2. Verifying the eligibility to register as a user of this Site;
  3. This registration will use the Mobile phone number as a user ID for our site and our site will maintain and manage your registration.
  4. Providing customer service that will respond to users’ queries, feedbacks, claims, or disputes;
  5. Facilitating the communication between buyers and sellers on the Site; We may use your name, phone number, residential / business address (all marketing data) to provide notices, surveys, product alerts, communications, and other marketing materials to you relating to goods and services which are offered by us on the Site by an opt-in mechanism by which - by clicking the checkbox - you give us your consent for your personal data and if you don’t want to provide us your personal data you can use opt-out mechanism by which you can withdraw your consent.   6. This disclosure is being done as it may be required for any of the above purposes or as required by law or in respect of any claims or potential claims brought against us.

DISCLOSURE OF PERSONAL DATA

  1. When necessary, we may also disclose and transfer users’ Personal Data to our professional advisers, law enforcement agencies, insurers, government, and other organizations.
  2. Any Personal Data supplied by the user will be retained by us and will be accessible by our employees, any Service Providers engaged by us, and third parties.
  3. We may share the user’s Account Information with banks to enable the user’s transactions to determine the user’s credit worthiness and, in the process of such determination; we may need to make such Account Information available to banks and/or credit agencies.
  4. We have implemented security controls and associated procedures to keep your Account Information and other Personal Data secure from malicious users or intruders. These controls provide a reasonable assurance that the minimum-security requirements are in place. These controls do not guarantee that such controls can eliminate all of the risks of data- theft, data loss, or misuse of data.

COOKIES

We use “cookies” to store specific information about users and also track the user’s visits to the Site. A “cookie” is a small amount of data that is sent to the user’s browser and stored on the user’s system hard drive. A cookie can be sent to the user’s system hard drive only if the user will access the site using that system. If the user does not de-activate or erase the cookie, each time user uses the same computer to access the Site, our web servers will be notified of the user’s visit to the Site and in turn, we may have knowledge of the user’s visit and the pattern of your usage. Shipping, Returns, and Chargeback Policy (for Transactions between Sellers & Buyers)

At WNDY (Waste Not Dead Yet), our goal is to facilitate seamless waste transactions between sellers and buyers. Since WNDY operates as a marketplace where both parties engage directly, it is essential that sellers and buyers take responsibility for the terms of their transactions, including shipping, returns, and chargebacks.

By using our platform, you agree to the following policies:

1. Shipping Policy
For Sellers:

  1. Sellers are responsible for coordinating the shipping and delivery of items to the buyer after a transaction is agreed upon.
  2. Shipping costs, if applicable, should be discussed and agreed upon between the seller and the buyer before the transaction is finalized.
  3. Sellers must ensure that items are packaged securely and transported safely to prevent damage during shipping.
  4. WNDY does not handle or provide shipping services but may provide guidelines to help facilitate the process.

For Buyers:

  1. Buyers are responsible for providing accurate delivery information to the seller and coordinating delivery terms.
  2. Buyers should ensure that they inspect the goods upon arrival to confirm they match the agreed-upon description before accepting delivery.
  3. Any disputes related to shipping must be resolved directly between the seller and buyer.

2. Returns Policy
Given the nature of the items traded on WNDY, returns may not always be possible or applicable. Therefore, it is crucial for sellers and buyers to clarify return policies before completing a transaction.
For Sellers:

  1. If you offer returns, this policy should be clearly stated in your product listing.
  2. Sellers must outline the conditions under which a return is accepted, including who bears the shipping costs for returns.
  3. If a return is agreed upon, it is the seller's responsibility to handle the return logistics and refund the buyer accordingly.

For Buyers:

  1. Buyers must carefully review listings and confirm product details with the seller before finalizing the transaction to minimize the likelihood of returns.
  2. If a return is agreed upon, buyers must ensure the product is returned in the condition in which it was received.
  3. Buyers should initiate returns only if the product received significantly differs from the description or agreed-upon terms.

3. Chargeback Policy
For Buyers:

  1. WNDY does not process payments directly. Any payments made between buyers and sellers are handled through mutually agreed-upon methods (bank transfer, third-party payment gateways, etc.).
  2. In the event of a dispute or chargeback, the buyer must contact their payment provider and notify the seller of the issue immediately.
  3. Buyers should ensure that all communication with the seller is well-documented to resolve any disputes regarding chargebacks.

For Buyers:

  1. Sellers should maintain accurate records of all transactions, including delivery confirmations, to avoid unnecessary chargebacks.
  2. In the event of a chargeback, the seller must cooperate with the buyer and their payment provider to resolve the issue.

4. Disclaimer and Limitation of Liability
WNDY operates solely as a facilitation platform for buyers and sellers. As such, we do not:

  1. Handle the shipment, delivery, or transportation of goods.
  2. Guarantee the condition, quality, or fitness for a particular purpose of any items listed on the platform.
  3. Mediate disputes regarding shipping, returns, or chargebacks.

All transactions, including the terms related to shipping, returns, and payments, are the responsibility of the parties involved. WNDY is not liable for any damages, losses, or disputes arising from a transaction. Buyers and sellers must exercise due diligence when engaging in transactions on the platform.

5. Resolving Disputes
In the case of a disagreement or dispute related to a transaction, we recommend:

  1. Open communication between the buyer and seller to resolve issues directly.
  2. Proper documentation of all communications and transactions for reference in the case of a dispute.

Shipping, Returns, Refund and Chargeback Policy (Applicable to Buyers)
By using our WNDY (Waste Not Dead Yet) Platform and proceeding further with the services, you acknowledge that you have read, understood, and agree to abide by the terms outlined in the respective Policy pertaining to Shipping, Returns and Chargeback. WNDY operates only as a marketplace to facilitate seamless transactions between you as a buyer and seller(s) for waste management. Since you agree to engage directly with the Seller(s), you are responsible and liable for the terms of the transactions, including but not limited to shipping, returns, and chargebacks.

Shipping Policy
At WNDY, our services do not involve the sale or delivery of physical goods as it is an agreement between you and the Seller(s). Hence, a traditional shipping policy is not applicable. You are responsible to schedule appointment directly with the Seller(s) for pick-up or delivery of e-waste. In case of any change, you are responsible to notify the Seller(s) using WNDY.

Refund Policy
At WNDY, customer satisfaction is a priority. Since you have agreed to pay nominal charge for using the WNDY App, refunds are handled according to the services completion and/or any potential issues with the App. Please read the details below: Refunds shall only be issued in the form of Service Credits and are available under the conditions strictly arising out of technical failure or other service-related problems on the App and only if refund requests with relevant details, including a brief description of the issue, are submitted via wndy@zag-innovations.com within 03 (three) days of facing an issue with the App. WNDY team will review your request and respond within 03 (three) working days.
Once your refund is approved, WNDY reserves the right to offer Service Credits, to be used for future bookings. These credits will be applied automatically to your account and can be used within 02 (two) months from the date of issue.
If your refund is denied, we will provide a clear explanation of our decision and such decision shall be final and binding.

Chargeback Policy
At WNDY, we aim to provide a platform for transparent and seamless waste management services. To ensure fair handling of disputes and chargebacks, we have outlined our policy below: WNDY encourages users to contact us directly, through our support channels, to resolve any issues before initiating a chargeback. Allow us 03 (three) business days to investigate and respond to your issue. For genuine cases, we will work with you to resolve the matter through Service Credits.
You may file a chargeback, subject to our approval, and if a payment was made without your authorization; or you were charged incorrectly; or the service you paid for was not delivered or completed as described, and you have been unable to resolve the issue through WNDY’s customer support, in which case you need to present document proving our failure to resolve the issue.
Submitting a chargeback without first attempting to resolve the issue through WNDY’s customer service, or submitting a fraudulent or dishonest claim, is a violation of this policy. WNDY reserves the right to dispute and contest any chargeback that we believe is unjustified or fraudulent or dishonest, and we may suspend your account in addition to pursuing legal action to recover the said amount and any associated costs.
